Geo restored in some cities, others still waiting



 












LAHORE: In various cities of the country, cable operators have restored the Geo TV transmission though people have complained about shifting of different Geo channels to later numbers. Complaints about illegal suspension of Geo News transmission are also pouring in from various parts of the country.
In Khanqah Dogran, where people launched a severe protest against the suspension of Geo News transmission from time to time, the cable operators have restored it. However, people complained that Geo News has been put at 33 number on cable instead of its real position on 14.

Expressing their pleasure at the Geo News restoration, they demanded the cable operators to place their favourite channel at number 14 again. Punjab Parliamentary Secretary for Information and Culture Rana Muhammad Arshad regretted that Geo News transmission was suspended for 17 days and Geo Tez for 40 days in Shahkot. He called upon the cable operators to restore the Geo channels immediately. He said the Geo channels are the most favourite channels of the people and the Geo TV network played an unforgettable role in the restoration of democracy and movement for an independent judiciary in the country.

Despite Pemra orders, Geo not yet fully restored



 












ISLAMABAD: Despite the clear orders of the Supreme Court (SC) and the Pakistan Electronic Media Regulatory Authority (Pemra), Geo News is still not accessible to a large number of viewers across the country, putting a big question mark on the writ of the government and rule of law in the country.
Reports from across the country suggest that hidden forces are preventing the restoration of Pakistan’s most popular channel even after the written directives of Pemra issued after the expiry of the 15-day ban on June 20, 2014.

In another blatant violation of the Supreme Court order, the channel numbers of Geo News and other members of Geo family including Geo Tez, Geo Super and Geo Kahani have been changed illegally.

The apex court, while disposing of Geo News petition on May 26, directed Pemra to restore Geo News on its original position but the channel is either completely blocked or placed on last numbers where signal quality is too poor to show the clear transmission.

On the other hand, while Pemra has imposed one-month suspension on Geo Entertainment for showing blasphemous content, it has taken no action against other channels which aired the same content in their morning shows. A private channel has even reproduced the same content repeatedly but Pemra has turned a blind eye towards the issue. It seems that Pemra has become a helpless regulator as it has failed to ensure implementation of its orders in letter and spirit.

On June 20, Pemra suspended the licence of a private TV channel for 15 days for airing anti-judiciary programmes but the authority could not fully implement the orders and the transmission continued in violation of law. Four days later, Sindh High Court (SHC) restored the transmission of the private channel and it was back on air immediately.

But the same could not happen in case of Geo News. The authority had suspended the licence of Geo News for fifteen days on June 5. The channel respected the law and suspended transmissions in Pakistan on the same day.

Upon completion of the suspension period on June 20, Pemra forwarded the notification of restoration of Geo News to all its regional offices with direction that the country’s cable operators should obey the order of the Supreme Court according to which the position of Geo News on cable TV network should be the same as was in the second week of April, 2014.

However the directions of authority were not taken seriously by the cable operators in several parts of the country.The management of Geo News has already suffered huge financial losses worth billions for illegal blockade and repositioning of Geo and other channels of the family including Geo Tez, Geo Kahani and Geo Super.

Geo facing blockage despite Pemra orders: CPJ

ISLAMABAD: The Committee to Protect Journalists (CPJ) has declared that the Pakistan government had failed to fulfill its commitment on the seven basic points agreed with the world journalistic body a few months ago in order to ensure the freedom of the media.

The CPJ expressed its deep concern about the deteriorating climate for press freedom in Pakistan, which undermines the recent commitments made by the government. The body also urged the government to reinstate Geo in the country.

The CPJ in its letter written to the Prime Minister of Pakistan urged him to follow his pledges to address media freedoms with meaningful action. In its letter, the CPJ reminded the prime minister and the government of fulfilling the promises that they made to the CPJ’s delegation.

“Since our meetings, conditions for journalists working in Pakistan have drastically deteriorated. In April 2014, gunmen shot Geo News senior anchor Hamid Mir. Mir survived the attack but sustained wounds to his abdomen and pelvis”.

Similarly, the next month, two foreign journalists were expelled from the country after being told their visas would not be renewed.The Hindu correspondent Meena Menon and Snehesh Alex Philip, correspondent for the Press Trust of India, left Pakistan within seven days.

“On May 20, some members of Pakistan’s Electronic Media Regulatory Authority (Pemra) announced that licenses for Geo News, Geo Entertainment and Geo Tez, channels under the Geo TV Network, had been suspended. Later that day, Pemra issued a press release saying the order had “no legal standing” since the meeting had been attended by only five of its 12 members, the CPJ stated in its letter.

Zafar Aheer, an editor of Daily Jang, was beaten by six armed men as he was returning home from work on June 3. The assailants confiscated his phone and fired shots around his car before fleeing. Aheer told BBC Urdu that the assailants accused employees of the Jang group of being traitors, Jews, and Indian agents. He also said he had received death threats in connection with his affiliation to the media group.

The staffers at The News—including Umar Cheema, who wrote critically about the attack on Mir—have received threats. Vans carrying Jang’s newspapers have been torched in Lahore, Lodhran, and Rawalpindi.

Expressing its severe concerns about the behavior of cable operators on the Geo News issue, the CJP states, “On June 6, Geo News was fined and given a 15-day suspension by Pemra. The channel went from providing news to millions of people to a blank screen. Pemra allowed the channel to begin rebroadcast after 15 days, but news reports said cable operators were continuing to block the channel”.

On June 20, Pemra suspended Geo Entertainment’s license for 30 days and ARY News’ license for 15 days and imposed on each outlet fines of 10 million rupees. News reports said Geo was banned for “insulting the religious sentiments of viewers” in one of its morning shows, and ARY was banned for “bringing the high courts into disrepute” in connection with a critical programme.

This sets a very dangerous precedent and opens the door for future attempts to shut down news channels that are critical of the state and its agencies. More than 7,500 people are employed by Geo, and their livelihoods and safety are directly affected by the threats to Geo.

The CPJ called on the government to reinstate Geo’s ability to operate and broadcast in the country and it should ensure journalists at all news outlets are able to work safely and freely in Pakistan.

The international body for journalists further urged the constitution of a joint government-media commission to review anti-press attacks and improve security. This would be a great step toward improving the climate for press freedom in Pakistan.

The CPJ further reminded the government of recognising the scope of the crisis that journalists face in Pakistan and the damage that the country’s record of impunity in the murder of journalists has done to its international reputation.

Geo News resumption: Cable operators continue to defy PEMRA, SC orders




KARACHI: Cable operators continued to defy the orders of Pakistan Electronic Media Regularity Authority (PEMRA) and Supreme Court pertaining to the restoration of Geo Network channels across Pakistan.

The channel’s transmission had earlier been suspended on June 6, 2014 on the complaint filed by the Ministry of Defence. A fine of Rs10 million had also been imposed on the channel.

A notification (dated June 20, 2014) issued by PEMRA states that Geo News is allowed to resume transmission at 12am on June 21, 2014, however, cable operators have claimed that they have not received any such notification and continued to defy PEMRA and Supreme Court orders.

The notification directs all the regional offices to direct distribution networks in their respective regions to begin relaying Geo News at the above mentioned time and date.

A special reference has also been made to the orders of the Supreme Court of Pakistan. The order states:

2. The grievance of the applicant, as raised by its senior counsel, was that the PEMRA was not abiding by the report of Mediator and the subsequent orders passed by this Court on it. Raja Muhammad Ibrahim Satti, learned Sr. ASC for PEMRA was present in the Court as a Caveator along with Mr. Zahid Malik, Head of Legal Department, PEMRA, and on instructions from Mr. Zahid Malik, Raja Muhammad Ibrahim Satti, learned Sr. ASC stated that the PEMRA shall abide by the terms of order dated 13.08.2012 passed in Constitution Petition No.51 of 2010, by which the report of Mr. Javed Jabbar, the Mediator, was made part of the said order and that the PEMRA will ensure that there is no shifting of the channels contrary to or in violation of the order dated 13.08.2012

The PEMRA notification directs all regional general managers to strictly comply with the above quoted orders by directing all distribution networks to restore Geo News to its original position to avoid any contempt of proceedings in the Supreme Court.

ARY News, which was suspended by PEMRA on Saturday, continued to be relayed by cable operators on their networks.

Geo News is back

ISLAMABAD: The licence of the most popular channel of Pakistan, Geo News, has been restored by the Pakistan Electronic Media Regulatory Authority (Pemra) after 15 days, which caused a wave of jubilation among the viewers, who will now get an opportunity to watch their favourite channel once again.

After the suspension of 15 days, Geo News started its transmission once again at midnight of Friday and Saturday.Impartial channels flashed this news as ‘breaking news’.

Pemra has forwarded the notification of restoration of Geo News to all its regional offices with strict direction that the country’s cable operators should obey the order of the Supreme Court according to which the position of Geo News on cable TV network should be the same as was in the second week of April, 2014.

Similarly, Pemra has directed its regional offices to present reports for implementing its orders. The regulator has also formally issued a press release to all the newspapers, news agencies and channels regarding its notification.

Before the suspension of Geo News, some of the cable operators illegally kept the transmission of Geo Kahani, Geo Entertainment, Geo Tez and Geo Super off air for 45 days. Other cable operators shifted the Geo channels to the last numbers on the cable network.

Geo News also obeyed the order of Pemra and paid a fine of Rs10 million. In addition, the shift in position of the channel cost billions of rupees to the Geo Group.

All the viewers were of the opinion that they were missing the news and analysis of Geo News. They prayed for reinstatement of Geo News and expressed pleasure after its restoration on the night of June 20, 2014.

Geo closure, penalty not enough: Asif



 












ISLAMABAD: Minister for Defence Khawaja Muhammad Asif on Saturday said that the Ministry was absolutely not satisfied with the penalty awarded by the Pakistan Media Regulatory Authority (Pemra) to Geo News after declaring it guilty of misconduct.
According to a press statement, the minister of defence further said that they reserved the right to take up the matter at the next appellate level for enhancement of the punishment awarded to Geo.

He said they were ready to submit a reply in response to a suit filed by Geo and fully prepared to defend the charges, levelled by it against the Ministry of Defence and ISI in a court of law.

Ban on Geo excessive, one-day suspension was enough: Altaf



 












LONDON: Altaf Hussain, the exiled leader of the Muttahida Qaumi Movement (MQM), has strongly condemned the suspension of Geo’s licence saying that the decision by Pemra was excessive as the ban could have perhaps been slapped “for a day”.
He suggested that the Geo licence suspension was an attack on the free press and expressed his support for the freedom of the media.

He said that he respected and trusted the British justice system and hoped that justice will be done in the case of the money-laundering probe for which he was arrested and released on police bail.

Speaking live from the International Secretariat soon after his release from the Southwark Police Station, Hussain, 60, who has been living in the UK since 1991, said that he would not comment on his case because it is with the authorities but said he hoped justice would prevail and that he respected “British laws and the judicial system”.

Altaf Hussain was arrested on Tuesday morning by Scotland Yard from his home on suspicion of money-laundering but he spent three nights in the Wellington Hospital due to his ill health.

Scotland Yard said in a statement: “The 60-year-old man arrested on Tuesday 3 June on suspicion of money laundering has been released on police bail to a date in July pending further enquiries. Police bail is the term used when a person arrested in connection with a criminal offence is released from police custody whilst the police investigation continues and until they are next required to appear at a police station. When a person is released on police bail they are required to return to the police station at a specific date and time”. The news of Mr Hussain’s release prompted celebrations across the world wherever his party has a presence, including in London. On the Borough High Street, traffic came to a halt as Hussain came out of his car’s sun roof and waved to his supporters who had been waiting outside the police station for over 10 hours.

“Those who stick with what is just never have to face defeat. I believe in Imam Hussain (AS) who mounted a struggle for the right reasons in Karbala against the forces of Yazeed. Like a true Hussaini who believes in the cause of justice and fairness, I will never surrender even if it means sacrificing my life for the fulfillment of a right cause. I will never stop speaking the truth, be it before the Pakistani authorities or the British. My mission will continue regardless of what happens to me,” a defiant Hussain told his charged supporters, who kept raising slogans at the International Secretariat at regular intervals to express their support to Mr Hussain.

Hussain said he never retreated from his stance and he would continue to say what is right, irrespective of how tough the time may be. “Every person deserves the right of equivalent treatment…. I did not bow before forces even when I was arrested in 1992,” he said.

Altaf Hussain thanked the staff at the Wellington Hospital and the Metropolitan police staff for congenial treatment during his stay at the hospital and police custody. “The police attitude was hospitable both in the lockup and at hospital and I am thankful to them for this.”

Altaf Hussain expressed his gratitude for “those who raised their voice over his arrest”. Hussain mentioned all political parties, minus the PTI, and thanked them for their support but praised PM Nawaz Sharif for showing leadership and arranging consular access for him.

Altaf Hussain was welcomed at the International Secretariat by Dr Asim Hussain and Wajid Shamsul Hasan. A delegation of the All Pakistan Muslim League (APML) headed by Ifzaal Siddiqui remained at the police station and at the MQM Secretariat to show support on behalf of former President Pervez Musharraf.

Altaf began his speech with recitation from the Holy Quran. He added: “The greatest strength for people who struggle against injustices is patience. It is the patience that enabled the Ahle-Bait to prevail over the forces of Yazeed forever. Hazrat Imam Hussain (AS) sacrificed his life but did not bow his head before the forces of Yazeed. When my brother and nephew were arrested, I did not beg for their lives. I accept martyrdom like Imam Hussain (AS).”

Hussain said that his legal team was looking into the allegations of money-laundering and will be formulating a response as per requirements but refused to comment any further on this.

Politicians, lawyers condemn Geo channel shutdown

KARACHI/LAHORE/PESHAWAR: Media watchdog Pemra’s decision to suspend the Geo TV licence for 15 days on Friday drew strong criticism from political leaders and lawyers.

PPP Sindh General Secretary Taj Haider on Friday said it was very unfortunate that private TV channels were being shut down. He said the government should have stepped in much earlier to save the situation but it played no conciliatory role.

He said it was again very unfortunate that an intense war was going on between the media houses. He said the working journalists must maintain complete unity in their movement and struggle and they should secure concrete promises and commitments from their respective owners that they would fight for their (owners’) cause but in return conditions of their services should be improved.

“In the past, we fought for our English colonial masters but only on the promise that afterwards we would be given freedom,” he said in support of his argument. Waqar Mehdi, Information Secretary of the Pakistan People’s Party, Sindh, said that due action against the Geo News television should be taken fully in accordance with the Constitution, the law of the land and the Pemra rules and there should be no violation of the law and the rules.

He said an independent, transparent, and proper inquiry should be conducted and the Geo News TV issue should be resolved as per the law. He said if the suspension of Geo News TV license for 15 days was in line with the rules and laws of Pemra, then there was no harm in it.

Syed Najmi Alam, General Secretary, PPP Karachi Division, said that suspension of the license and transmission of Geo News merely for 15 days was beyond his comprehension given the seriousness of the allegation pending against the Geo News. Given the allegation being probed against it, in case the Geo News had committed such a grave mistake, then the TV news channel should have been shut down forever. It seems to be a compromise between the parties and stakeholders concerned, said the local PPP leader.

The PML-F Media Coordinator, Kamran Tessori, said his party believes in press freedom and whenever and wherever the press voice was gagged, they will condemn it.Senator Saeed Ghani of the PPP opined that all the parties should have attended the Pemra meeting. He said during the Friday’s meeting, there were no private members and in the previous meeting there were private members. Ghani said though the Jang Group had always been against the PPP, they still say an injustice had been done.

The PML-Q and PML-N leaders and adviser to Sindh Chief Minister Sharmila Farooqi refused to offer any comments.MQM Rabita Committee member Engineer Nasir Jamal at first offered no comments; however, when insisted, he said: “Allah Taala Geo Kee Mushkil Asaan Karay.”

Despite repeated calls, Sindh Minister for Information Sharjeel Inaam Memon was not available for comments.KUJ President G M Jamali strongly condemned the decision of Pemra and said the authority should have heard both the sides. He said it was totally unjustified and unwarranted not to listen to Geo TV.

The KUJ and PFUJ strongly condemned the decision. The religious parties refused to make any comments over this issue.Legal experts and senior lawyers have condemned the one-sided Pemra’s decision of suspending the Geo News licence for 15 days and said it was a clear violation of the Article 10(A) of the Constitution.

Former judge of the Sindh High Court and renowned lawyer Rasheed A Razvi said the due process of law was not followed in the case, which was a clear violation of Article 10 (A) of the Constitution. He said the decision was politically-motivated.

Former assistant advocate general, Sindh, Syed Jalil Ahmed Hashmi, said it was an unlawful decision and could be challenged in the Sindh High Court under Article 199 of the Constitution. Hashmi said the decision was taken in haste and without providing an opportunity to Geo TV to defend it. He said the Pemra decision will definitely be set aside by the appellate court.

Renowned law expert and special public prosecutor Abdul Maroof said: “To me, the decision itself has committed many violations of law dealing with the right to know, right to speech and right to expression and it was a matter to be dealt with under Article 199 and Article 184 (3) as it not only involves the question of public interest, but also a matter of violation of fundamental rights guaranteed by the Constitution.”

Maroof said such decisions hold no water in the eye of law and were finally reversed and certainly this wrong decision would meet the same fate in the near future. Advocate Noor Naz Agha observed: “I am deadly against a decision that does not take into account necessary legal aspects of the matter and are drawn unheard of the stakeholders concerned.”

She said it was not an occasion of happiness and instead it was the tragedy of the day because such negative decisions could also affect other media houses. She said Pemra must honour the due course of law and due process of law while dealing with the matters of media and journalism, which were bound to do investigative reporting of the events.

According to the Pemra notification, the licence will remain suspended from June 06 till June 20. In Kasur, lawyers, journalists, traders, political workers and members of the civil society condemned the suspension of the Geo News.

In three emergency meetings held at kutchery and Lal Havely, the Unity Group of Lawyers, Insaf Group of Lawyers, HR activists and other organisations passed resolutions against the Pemra. Kasur BR VP Saleem Farrukh, Yaseen Farrukh advocate, Unity Group President Rana Naveed Ahmad Joya, Insaf Group President Saleemur Rahman, Sardar Sharif Sohdal advocate, Sh Ateeq Ahmad advocate, Naveed A Malik, Shazia Ajmal advocate, MM Tariq Advocate, Zohaib Baloch and others condemned Pemra and termed its decision a conspiracy against Geo, the media and democracy.

In Lahore, protesters rejected the Friday’s decision of Pemra saying the decision reflected the government’s intentions on the independence of the media and value of freedom of expression in the country.Carrying banners and placards inscribed with anti-Pemra, anti-Rathore and anti-government slogans, the protesters in hundreds gathered outside the Jang/Geo offices on the Davis Road and condemned the Pemra decision.

The Muttahidda Christian Rabita Committee on Friday denounced the suspension of Geo News licence by the Pakistan Electronic Media Regulatory Authority (Pemra) and asked the authorities concerned to review the decision.

In a press statement, provincial president of the committee, Tanveer Sherazi, said the ban on Geo News was biased and an injustice. “About 10,000 employees of Geo, Jang Group would be affected by the decision,” he said.

PFUJ, APNEC, SAFMA, LPC concerned over Geo News closure



 













ISLAMABAD/LAHORE: The Pakistan Federal Union of Journalists (PFUJ) and the All Pakistan Newspaper Employees Confederation (APNEC) have expressed reservations over the Pakistan Electronic Media Regulatory Authority’s decision to suspend the Geo News for 15 days and impose Rs10 million fine, terming it disastrous for the freedom of the press.
According to a press release issued here on Friday, central leaders of both the unions in a meeting led by PFUJ President Afzal Butt reviewed in detail the situation of Geo after April 19’s life attempt on Geo News anchorperson Hamid Mir, attacks on the Jang Group journalists and burning of The News, Jang newspaper vans.

The PFUJ and APNEC leaders also strongly condemned the illegal decision of closing the Geo News by cable operators. They also demanded of the concerned quarters that after completing the 15-day ban on Geo News, the same should not be extended in any plea and no hurdles be made for Geo in performing its professional and journalistic activities.

They also decided that PFUJ, APNEC and all press club bodies would visit the Geo offices throughout the country to express solidarity with them on June 7 (today). Meanwhile, civil society and media leaders, in a meeting held at the Safma Secretariat, condemned the suspension of Geo News for 15 days by Pemra and termed it an assault on the freedom of expression and democratic values according to a press release.

Attacks on journalists and media houses with impunity and strangulation of a media house is a stark reflection of authoritarian tendencies that may be fatal for the overall democratic dispensation, observed I.A Rehman, Director of Human Rights Commission of Pakistan. Senior journalist Hussain Naqi lamented the disunity among the media ranks and called for unity among the media persons for the freedom of press and safety of journalists while criticising those forces who are using strong-arm tactics to muzzle the press.

While opposing the suspension of Geo, Tehreek-i-Insaf MNA Shafqat Mehmood expressed concerns about the way the media had been flouting its freedom by running vicious and slanderous campaigns against politicians. He emphasised that he was for more freedom and against restrictions with a greater sense of professional responsibility.

Commenting on the current state of the media, senior journalist Anjum Rashid said that never in the history, the media have so amateurishly undermined its own freedom to settle business scores. Educationist Abbas Rashid emphasised the need to view the press freedom and safety of journalists in the broader perspective of freedom of expression and right to life that cannot be compromised.

Columnist Kamran Shafi warned that attacks on the press will lead to attack on democracy and the Nawaz Sharif government should not have abdicated its writ in the face of unlawful conduct of certain forces.

Director South Asian Partnership Tehseen proposed that all the democratic forces must unite in defence of the freedom of press and democratic values. Editor Farah Zia said that the state institutions must follow tyhe due process of law and justice rather than clamping down on a media house and its workers.

Journalists from various media organisations lamented the current environment in which they are being forced to work against their conscience and called on media houses to allow professional editors to perform their role in keeping high professional standards and media ethics. They appealed to working journalists to unite against the attacks on their colleagues and protect their freedom and economic rights.

Summing up the consultative process, Secretary General of Safma Imtiaz Alam said that there cannot be any compromise on the freedom of expression and safety of citizens and journalists. We demand, he said, more freedoms and will stand up against the violation of fundamental human and civil rights, including a free media. Condemning the attacks on journalists and forcible shutdown of the Geo News, he said infighting between various media houses had undermined the very premise of press freedom and a divided media community cannot fight for a cause they have themselves demolished.

Alam said freedoms and rights are indivisible and can be fought and defended by all the democratic forces together as a part of strengthening the democratic values and democratic system. He warned against those adventurous elements that are resorting to unconstitutional and illegal means to impose their will or trying to pitch the media against the national security institutions. He said the media was bound by the Constitution not to bring armed forces and the judiciary in disrepute. He underlined the necessity to expand the horizon of freedoms while accepting the greater responsibility to use their freedom with care and professional caution. He cautioned against further aggravating the current tussle between the Jang Group and the military establishment. The time is for fire-fighting and not for adding fuel to the fire as some elements are desperately trying, he observed. He emphasised the need to adopt a legal course of action and called upon parliament, political parties and civil society organisations to play their due role in resolving the current tussle between a section of the media and the armed forces that deserve the support of the whole nation in its struggle to eliminate the scourge of terrorism.

The participants resolved to convene a national conference in defence of the freedom of expression, tolerance, democratic values, observing due process of law, a responsible and free media and strengthening the constitutional role of all state organs within their respective spheres.

Our correspondent adds from Lahore: The governing body of Lahore Press Club (LPC) on Friday condemned the Pemra’s decision to suspend the Geo News for 15 days as a punishment for running an alleged campaign against the ISI and its chief in April.

In a statement, the LPC Governing Body members, while terming the move as an economic murder of journalists, demanded immediate withdrawal of the decision.

LPC President Arshad Ansari, Vice-President Afzal Talib, Secretary Shahbaz Mian, Joint Secretary Farzana Chaudhry, Treasurer Asif Chaudhry and others made it clear that the journalist community would resist suspension of any channel and not accept dictatorial acts in the country.

They said no compromise would be made at the cost of media freedom and economic murder of journalists.They appealed to the civil society, lawyers, human rights organisations and the people of Pakistan to support the journalist community during the current crucial period.

They said Pemra had punished Geo today and other channels or media outlets could face the same fate if they did not stop their internal fight. They urged all media houses to get united at a single platform to defend the media and its freedom.They announced that a protest would be held outside the LPC on Saturday (today) at 5pm against the suspension of Geo News.

Suspension of Geo News license draws outrage




LAHORE: Lawyers, politicians and civil society has strongly condemned the PEMRA decision, suspending Geo News license for 15 days.

Eminent lawyer and human rights activists Asma Jahangir said PEMRA's decision to suspend Geo News license reflects that not only a TV channel is being targeted it had also inflicted damage to the whole media industry.

Reacting over the PEMRA decision, Jahangir said that with the decision of the media watchdog against Geo News a deadlock has come to an end and now things should move forward after this decision.

Senator Zahid Khan of Awami National Party in his reaction to the PEMRA decision said, “Today what happened to Geo could happen to anybody else.” He condemned the suspension of Geo News and said, ”We consider this a sheer injustice to Geo.”

Pir Sabir Shah, President PML-N KPK chapter, said that PEMRA decision to suspend Geo News license was tantamount to a move against freedom of press.

Known as doyen of journalists in Khyber Pakhutunkhwa, Rahimullah Yousafzai said the regulatory authority gave one-sided decision without hearing Geo's stance.

'We are shutting down Geo out of respect for law’





KARACHI: “Although we don’t agree with Pakistan Electronic Media Regulatory Authority (PEMRA) decision to suspend our license for 15 days, we are going to shut down our transmission out of respect for law,” said Geo News on Friday few hours after the media watchdog decision.

“We have received a letter from PEMRA asking us to shut down the channel. We are shutting down the channel and say you goodbye out of respect for law despite we don’t agree with the decision,” said Geo News.

Geo News has been shut down despite government’s repeated assurances that the channel would not be taken off the air.

C’wealth media body concerned over attacks on Jang, Geo Writes to PM Nawaz

LONDON: Commonwealth Journalists Association (CJA) President Rita Payne has written a letter to Prime Minister Nawaz Sharif expressing concern on targeting the Geo TV and Jang Group.

According to a press release, Payne said during the past few weeks, many incidents of attacks on the media in Pakistan have surfaced. Attack on Geo TV anchor Hamid Mir in Karachi and torture on resident editor, Jang Multan, are aimed to muffle the voices of rivals, which is a cause of concern for the CJA.

Payne said she understands that it was time when journalists and editors would cross the line between reporting and intentional commentary on an issue. She said the hard-won freedom of press in Pakistan needs to be protected. She appealed to Nawaz to make sure protection of the media against torture and pressure.

Dispute should end after Geo apology: PPC

CHAKWAL: Pakistan Press Council Chairman Shafqat Mahmood Abbasi has said that apology and regret are the two things that amount to a big punishment and these two things are very significant in an Islamic society and the civilized countries.

Addressing the concluding session of the two-day journalism training workshop of the CPDI, he said while Geo News has sought apology and regretted committing a mistake then the dispute should end.

The Press Council chairman said the media itself prepares its code of conduct and it is acknowledged that the media is not free of moral and social values. Parliament is a supreme institution and is also bound by certain rules and regulations. He said that journalists have won press freedom with much struggle and has not been gifted by any ruler.

The chairman said the press freedom allowed in Pakistan is not granted to the media even in India, which is the biggest democracy of the world. He said while a vibrant media and independent judiciary are necessary for a strong democracy, media suffers greatest danger from within. He said the media should hold internecine talks. He said the print media in Pakistan is very responsible and the electronic media is only 12 years old and requires to be made more responsible. Shafqat said the law of right to information in the Khyber-Pakhtunkhwa will strengthen the media. He expressed hope that the situation of the media will improve.

You want Geo on its knees, once, twice, three times: Asma

LAHORE: Human rights activist and former president of the Supreme Court Bar Association Asma Jahangir has said she supports freedom of expression and the independence of the media, and punishing any TV channel is not an act of any pillar of the state but of dictators.

Addressing a lawyers gathering at the Aiwan-e-Iqbal here on Thursday, Asma said whatever Geo did was not fair. No journalistic ethics permit putting the picture (of any official) on the TV screen for hours over mere allegations, she said, adding that there was nothing new in this, however, as “Geo as well as all other TV channels have done it to us all in the past”.

“You may fine it (Geo) for the mistake, you may force them to apologise”, but what is this attitude, she asked. “You say no pardon, you say you will bring this organisation to its knees, once, twice, thrice, and there seems to be no end to it,” she added. She said if the army rulers believe they can strangle the freedom of expression in this country, they are mistaken.

Asma said when the judiciary indulges in politics instead of providing justice, we criticise it. “We did it earlier, and we do it even today,” she added.

Asma regretted that the media have started dictating even to lawyers. “They say a lawyer must ask them (the media) before taking up any case. If they will permit, you take up a case, and if they don’t want you to, you don’t go for it,” the lawyer leader said.

Asma said the government claims that their heart bleeds at the misuse of public money. “If it is public money then why have you provided six employees at government expense to the former CJ, whose son is still staying in the guest house,” the rights activist asked. She also questioned the appointment of Faqeer Hussain as the director general of the Federal Judicial Academy after his retirement as the Supreme Court registrar, and termed it in violation of merit.

PEMRA ignores SC orders to restore Geo





ISLAMABAD: The Pakistan Electronic Media Regulatory Authority (PERMA) has disregarded Supreme Court orders of restoring Geo channels on cable networks across Pakistan.

According to a report published in The News by Ahmad Noorani, Geo television has decided to knock on the doors of the Supreme Court again by moving a contempt of court petition against PEMRA after the apex court’s orders to restore Geo transmission were completely ignored.

The Supreme Court in its order on May 26 ordered PEMRA to restore Geo channels stating that cable operators did not have the authority to remove or reposition channels. Referring to its ruling in 2012, the apex court stated that channels can only be blocked if their license is suspended or cancelled by PEMRA.

Despite the Supreme Court orders, PEMRA has failed to take any action to restore Geo channels which cannot be seen in 90% of the country. People have been deprived of their favourite Geo channels over PEMRA’s failure to implement SC orders.

Still blocked Geo to sue Pemra for contempt of court


 













ISLAMABAD: Geo television has decided to knock on the doors of the Supreme Court again by moving a contempt of court petition against the Pakistan Electronic Media Regulatory Authority (Pemra) after the apex court’s orders to restore the Geo transmission were completely ignored and the government’s ‘instructions’ on this count simply put into dustbin by the Pemra. As a result, Geo is still blacked out across the country.

After the horrible attack on Pakistan’s star journalist and Geo News senior anchorperson Hamid Mir on April 19 in Karachi, certain forces started getting the transmission of Geo News closed or shifting the channel to last numbers on cable networks. Within a few days, Geo News and other channels of the Geo family were either put off air or were thrown on the last numbers on cable networks in 70% areas of Pakistan.

Viewers could not watch their favourite channel on the last numbers because of limited channel carrying capacity of their TV sets or bad signal quality at those numbers. Geo continuously informed Pemra about the closure or obstruction in its transmission but the authority never took any action and remained mysteriously silent though it was its fundamental duty to resolve the complaints from any channel facing closure.

However, later the hidden forces intensified their action against the Geo News and all other channels of Geo family were put off air in more than 95% areas of Pakistan and the organisation itself announced that channels were completely closed in Pakistan. After failing to get any relief from Pemra even after filing five complaints, Geo moved the Supreme Court which in its judgment clearly ordered the authority to get the Geo News and all Geo channels restored immediately and shifted to their original positions.

After the Supreme Court had started its proceedings, the government also asked the Pemra to try to get Geo restored. The Pemra issued a letter to all the cable operators to restore all the Geo channels to their original positions.

However, Pemra’s action remained confined to issuing this letter and also taking action against the powerful cable operators at some places but the result was almost zero. The reason was backing of cable operators by some hidden forces and incompetence and insincerity of Pemra officials at many places. All this resulted in complete disregard of the Supreme Court’s May 26 judgment, which was not implemented anywhere asGeo is still facing a countrywide blackout and also terrible conspiracies against it and its staff on a daily basis.

Geo is the most popular channel of Pakistan known for open debates and independent and impartial analysis and comments. Geo is also known for providing the latest information and exclusive news to its tens of millions of viewers across Pakistan and many parts of the world.

Not only Geo is completely off in Pakistan and Pemra is unable to restore Geo and its channels and thus implement the clear judgment of the Supreme Court but the staff of Geo is also working under constant threats. Most interestingly, the so-called democratic provincial governments are so far unable to provide protection to Pakistan’s largest media house and its journalists and workers.

Geo transmission remains suspended all over Pakistan


 














ISLAMABAD: In blatant violation of the Supreme Court’s judgment on Monday, the Pakistan Electronic Media Regulatory Authority (Pemra) remained completely unmoved due to mysterious reasons and failed to get the Geo News and other channels restored despite the fact that the apex court had declared that criminal proceedings would be initiated against those creating hurdles in restoration of transmission of the channels, writes Ahmad Noorani.

The Supreme Court has ordered that not only all the channels of Geo family shall be restored but also their position must not be changed/altered or obstructed.

Clearly knowing that not implementing the order will be contempt of court, the Pemra officials remained unmoved and Geo News and other channels of the group remained off air in majority of the areas of the country.

Cable operators in different cities refused to restore the Geo News transmission even when citizens informed them of the verdict of the Supreme Court penned down on Monday.But the Pemra officials remained indifferent to all these issues and the apex court’s orders.

Geo moves Pemra to hear its case on merit


 













ISLAMABAD: Geo television has moved Pemra, holding that before proceeding on the complaint of the Ministry of Defence the authority should take the opinion of the Council of Complaints (CoC) under the Pemra law and that Geo should be heard on the merits of the points raised in the complaint under Section 30(3) of the Pemra Ordinance.

The application filed by the Independent Media Corporation (IMC) also made a reference to the Supreme Court’s January 15, 2013 judgment passed by the apex court in the Hamid Mir vs Federation case mentioning that the authority becomes incompetent to pass content regulations in the absence of a chairman and as presently there is no chairman, the authority is not complete and thus cannot proceed in this matter.

The Geo application also pleaded that three members of the authority, namely Israr Abbasi, Mian Shams and Fareeha Iftikhar, have shown their mind and have repeatedly announced to revoke the Geo channel’s licences so they could not sit in the authority as judges on a complaint against Geo. The Geo application also pleads that on May 6, 2014, the lawyer of Geo, Muhammad Akram Sheikh, only submitted some legal objections and is yet to present his submissions on the merits of the complaint filed by the Ministry of Defence, and Geo should be given this right under Section 30(3) of the Pemra law.

The relevant parts of the application moved by Geo on April 27, 2014 read: “1. Your kind attention is drawn to the order of the Hon’ble Supreme Court of Pakistan dated 15th January 2013 passed by Mr. Justice(reported at PLD 2013 SC 244), wherein the Pakistan Electronic Media Regulatory Authority (“Pemra” hereafter) was held to be incompetent to pass content regulations in the absence of its Chairman. Relevant portions of the judgement are reproduced below: “5. We have earlier recorded that at least since 13-5-2011, Pemra has no Chairman. In our order dated 20-12-2012, we have also noted the serious procedural challenge raised by the petitioners, who contend that when the Content Regulations were in the process of being made or when the same were adopted and notified, Pemra did not have a Chairman and was thus not lawfully in existence. Mr. Kazmi [counsel for Respondent No. 2] contended that Dr. Abdul Jabbar was notified and was acting as Chairman of Pemra. This contention is not correct …”

“6. Based on the above, we are quite clear that the Content Regulations which were notified on 25-9-2012 cannot be construed as regulations issued by Pemra …”

“7. Mr. Kazmi then contended that even if Dr. Abdul Jabbar was not a validly appointed Chairman, the de facto doctrine, incorporated in section 3(4) of Pemra Ordinance, would save all his acts; and the Content Regulations too should therefore be deemed to have been saved. This contention is without merit. The statute cannot be read in a way which makes its most important and potent parts such as the provisions about the very composition of Pemra redundant. Such an interpretation of the de facto doctrine verges on utter disregard for the rule of law which is the foundation of our constitutional order. …”

2. Therefore Pemra, as per the above clear ruling of Honourable Supreme Court of Pakistan, in the absence of a Chairman, is not validly constituted to execute and perform functions of the Authority as contemplated by Sections 4 and 6 of the Pemra Ordinance 2002.

3. That notwithstanding the above cited view of the Hon’ble Supreme Court and without prejudice to the legal objections taken by Independent Media Corporation (Pvt.) Ltd. (the answering respondent) in reply to the Show Cause Notice dated 23.04.2014, it is further submitted as under: A. Proviso to Section 30(1)(b) of Pemra Ordinance requires that: ‘Provided that in case of revocation of a licence of a broadcast media, an opinion to this effect shall also be obtained from the Council of Complaints.’

As Authority has not yet obtained an opinion from the Council of Complaints, it is not allowed by the statute to proceed to revoke the respondent’s licence.

B. In addition to above, Section 30(3) of Pemra Ordinance provides: ’Except for reason of necessity in public interest, a licence shall not be … revoked unless the licencee has been given reasonable notice to show cause and a personal hearing.”

It may be noted that Pemra has not yet heard the answering respondent on merits of the complaint. During the hearing dated 06.05.2014, Muhammad Akram Sheikh, senior advocate Supreme Court, raised several preliminary legal objections, including the contention that in the absence of the chairman, Pemra was not lawfully authorised or empowered to hear the instant complaint. Having considered those preliminary objections, Pemra sought the opinion of the Ministry of Law on the legal objections raised. Akram Sheikh did not submit response on merit of the complaint.

C. Now that the authority has received the legal opinion from the Ministry of Law, it must comply with Section 30(3) to afford the answering respondent the opportunity to submit its reply to the complaint on merit. It is thus that the Authority is requested to give the answering respondent reasonable time for right of hearing, without which any decision taken by the Authority will be legally flawed and an abuse of power.

D. Lastly, in the interest of justice and fair play, we wish to place on record the undisputed fact that the following three members of the Authority, namely Israr Abbasi, Mian Shams and Fariha Iftikhar, have disqualified themselves from sitting as a judge and to adjudicate on the issue in question because they have repeatedly, through press conferences and also through various live interviews on different rival TV channels, vowed that they would revoke Geo News licence. All these three members are not only biased but hostile, they have each prejudged the matter even before the meeting of the Authority and hence they are not entitled to participate in the discussion, cast their votes and thus decide this matter.

Any decision taken against the answering respondents that is based on the votes casted by these three biased and hostile members shall not be sustainable under law. As a result of their hostile interviews and expression of their hatred and anger against answering respondent, the said members have rendered themselves incapacitated from taking any part in relation to the complaint as they have prejudged the fate of the complaint.

It is the duty of the Authority to exclude these members from the proceedings to ensure that the right of the answering respondents to a fair trial as guaranteed under Article 10A of the Constitution.

E. Therefore, the ex-officio and other members of Pemra are kindly requested to restrain Pemra from initiating any actions without referring the complaint to the Council of Complaints where the answering respondent is yet to make submissions on merits.

Lawyers, civil society, labourers join protest against Geo closure

LAHORE: The Protest against the ban/suspension of Geo TV is gaining strength with every passing day as more people from all walks of life, including members of civil society, lawyers, the journalist community, labourers and workers of the Geo/Jang Group, thronged outside the Jang, Geo offices to hold a protest demonstration here on Saturday.

The protesters, carrying banners, placards in favour the Geo/Jang Group, and terming the ban on Geo against fundamental rights, said that any such action would be tantamount to economic murder of around 50,000 workers of the largest media house.

Among the prominent persons who attended the protest were senior journalists Nasrullah Malik, Khawar Naeem Hashmi, Maqsood Butt, Bedar Bakht Butt, Sadia Sharif, Ameen Hafiz, Jang Workers Union President Rukhsana Nazli, General Secretary Waseem Babar, Fakhira Tehreem, Shahzada Irfan, Jamaat-e-Islami general secretary Ameerul Azeem, Sadia Jabeen of the PPP, Shahid Aslam, Imdad Qureshi, Zahid Rafique Bhatti, Sabir Awan, Zahid Ali Khan, Ijaz Manzoor, Ijaz Mirza, Farooq Chohan, Naseer Baig, Azhar Maqbool, Sadia Aziz, Huma Mir Hassan, Naveed Aslam, President Civil Society Pakistan Abdullah Malik, Sohail Butt, Muneer Khokhar, Adeel Khokhar, Shafqat Imran, Asim Naseer and Waheed Butt.

Nasrullah Malik said he had come to join the protest as defending freedom of press was the duty of every journalist. He said our (media) victory lies in defending our freedom against all dictatorial acts. Which Constitution allows to forcibly snatch copies of newspapers and to threaten the cable operators to shut a channel (Geo), Malik asked, adding that some black sheep exist in our community which need to be thrown out now.

Allama Siddique Azhar said it was a matter of grave concern that Geo TV is off air as employment of thousands of workers is attached with this largest media house. He said nefarious designs with the help of some other channels have been made to discredit the most reliable source (Jang/Geo) of information for the public only to serve some vested interests.

Bedar Bakht Butt said the attack on senior anchorperson Hamid Mir was not an attack on him alone, rather the whole community came under attack from some powerful quarters who do not want free speech and freedom of the media. He said a planned conspiracy has been put in place after the attack on Hamid Mir to cause unbearable loss to the Geo/Jang Group to oust democracy from the country. He said the time has come to join hands to fight with the ‘angels’ and dictatorial mindset if we want to continue telling the truth to the general public.

Maqsood Butt said by attacking Hamid Mir it seemed that a serious campaign has been launched to eliminate all those journalists who speak the truth and stand in front of all wrongs.

Yousaf Shah and Khursheed Shah while condemning the ban on Geo said all labourers and worker’s unions of the country are with the workers of the Geo/Jang Group at this crucial time, adding that Geo is being targeted only for raising a voice for the poor and the needy.

In his speech, Ameerul Azeem demanded all illegal actions initiated against the Geo/Jang Group be stopped immediately, saying that the media house is the pride of Pakistan. He said Geo and Jang are the voice of millions of Pakistanis and efforts were underway to malign their favourite channel and newspapers which is highly condemnable.

Shahida Jabeen said by discrediting the Geo/Jang Group through such malicious campaigns, some forces want to again impose martial law in the country by throwing out hard-earned democracy. She also asked her leadership to throw persons like Israr Abbassi and Mian Shams out of the PPP as they were dancing to someone else’s tune while sitting in the Pakistan Electronic Media Regulatory Authority (Pemra).

Nisar Safdar Advocate and Iftikhar Shahid Advocate said religious elements are being used by some quarters to settle scores with Geo and Jang as this media house always stood against the high and mighty of the country. He said the media along with the lawyers’ community fought for the independence of the judiciary and now the lawyers will support the media in their fight for freedom and justice.

A representative of the Baloch Ittehad said that it was Geo and Jang alone which highlighted and raised the issues of Balochistan. He said the Baloch nation stands with the workers of the Geo/Jang Group in their fight for truth and freedom.

Abdullah Malik said Geo and Jang always promoted truth, harmony, equality, rule of law in the country. He said damaging this largest media organisation of the country means damaging democracy as every one knows that the independent media would not allow any unconstitutional act in the country again. He said all other channels and media houses should learn some lessons from the management of Geo/Jang Group as they accepted suffering a huge loss in the past one month or so but they never surrendered their freedom to the ‘angels’. He demanded that the government should intervene by finding a solution to the whole mess, otherwise things may go from bad to worse.

Meanwhile, the governing body of the Lahore Press Club on Saturday held its meeting with the chair of LPC President Arshad Ansari and expressed their serious concerns over the ban/suspension of Geo TV across the country.

In a statement issued here, the members of the governing body, while terming the ban on Geo as the economic murder of thousands of employees of the largest media house, said that such action against the Geo/Jang Group on any pretext would not be acceptable to the journalists’ community. “We will not let anyone ban/suspend any channel or media house of the country. If such actions were initiated against any group, the whole community would resist the move with full force,” they said.

The participants of the meeting asked the cable operators to restore Geo TV’s transmission throughout the country otherwise protest rallies would be taken out in all parts of the country.

Besides Arshad Ansari, LPC Secretary Shahbaz Mian, Afzal Talib, Farzana Ch, Asif Ch, Zahid Rafique Bhatti, Qamar Zaman Bhatti, Rizwan Khalid, Khwaja Naseer, Mehboob Ahmed, Imran Sheikh and Bilal Ghauri participated in the meeting.
