“We have repeatedly raised voice over the raids, abductions and torture on MQM workers carried out by the death squads of police and other law enforcement agencies. Workers are being abducted and subjected to torture and executed in cold blood and their mutilated bodies were dumped on roads. We have tried the get the attention of our rulers on the serious and grave situation. However, they turned a deaf ear to our pleas and protests and they did not take notice of the killings. Judiciary also did not take any suo moto action on the killings. The situation has embolden these killers and they are carrying out extrajudicial murders with impunity. He demanded that the president, prime minister, federal interior minister and army chief should arrest the personnel responsible and prosecute them.

He prayed to Allah to give the martyred workers high place in Jannah and strength to families to bear the loss.

Two MQM nominees took oath on Tuesday as ministers in the provincial government headed by Chief Minister Syed Qaim Ali Shah. This was the seventh time the MQM has joined the government as a junior partner in Sindh and the third time it has joined the cabinet with the PPP under Chief Minister Qaim Ali Shah.

The Muttahida this time too nominated its trusted and experienced party men to the cabinet who served as ministers in the last government in the province. Both parties were engaged in negotiations for a year on forming a coalition and finally the talks were successful on Monday.

The MQM left the government in 1988 after differences with the PPP on the issue of military operation. However, the MQM this time joined the government with the PPP when the operation was going on in Karachi and the MQM claimed that its workers and supporters were being targeted in the operation.

Two days ago, the MQM claimed that its 47 workers had been kidnapped, others killed and hundreds jailed in addition to scores detained under the PPO without any reason. The MQM is the second largest party in Sindh and its leader Faisal Sabswari was nominated as the leader of the opposition in the House. However, the MQM changed its mind and now two of its nominees – Dr Saghir Ahmed and Rauf Siddiqi – have taken oath as ministers. The party expects more ministries in the second phase.

Portfolios for these two ministers would be announced later. The MQM demanded the major portfolio of local government and excise during the talks. The party expected the same portfolios that it held during the 2008 to 2012 governments. However, the PPP leadership has some reservations on the demand but Asif Ali Zardari has reportedly directed his party and the chief minister to accommodate the MQM at all costs.

MQM leader jailed for fraud not mortgage

LONDON: Imbisat Malick, a Muttahida Qaumi Movement’s London-based Central Co-ordination Committee member, was jailed because of his involvement with the MQM and the fraud for which he was prosecuted came to light during a police investigation into the finances of the MQM, court papers obtained by The News confirm.

Some MQM leaders have gone on record to state that Imbisat Mallick has been jailed for 21 months over a mortgage fraud that was his personal matter, but the court papers available with this correspondent unambiguously state that “the fraud came to light during a police investigation into the finances of the MQM, a Pakistani political party based in the UK, the investigations has shown that members of the organisation have access to large cash balances and have an extensive property portfolios.”

In cases where mortgage frauds are involved, police rarely get involved as banks pursue such civil cases, but Mallick’s conviction is unique in the sense that around 15 members of the Counter Terrorism Command Unit officials – the same unit that’s responsible for the murder investigation of Dr Imran Farooq and the associated money-laundering cases—raided the house of Imbisat Mallick under the Police and Criminal Evidence Act (PACE), after executing such warrants. The court papers clearly show that Mallick’s mortgage was 100 percent up-to-date. The court papers confirm that Mr Mallick, who was sentenced at Isleworth Crown Court here on 13th of January this year, didn’t cause loss to the lender—the Santander Bank—and used the house to live with his family and was not speculating the sale of the house. Mallick’s lawyers presented in the court the letter from the Santander Bank of 3rd January 2014, advising change to monthly mortgage and giving the details of the future payment. They demonstrated that the bank didn’t raise any concerns, was happy to carry on doing business with Mr Mallick and didn’t object to the mortgage arrangement with Mr Mallick.

The court papers show that the Scotland Yard detectives raided the property of Mr Mallick on 17th of July 2013 – roughly a month after the detectives raided the residential properties of the MQM chief Altaf Hussain and his cousin Iftikhar Hussain Qurasihi. On 24th of June, the police arrested Quraishi, 52, at the Heathrow Airport when he was returning to London after attending a wedding in Canada. The Counter Terror unit executed a dawn raid at Mr Mallick’s Northwood home on 17th July. The police took away mobile phones, navigation system, computers, multi media laptops, data storage devices and almost all documents found in the house. The News has confirmation that the detectives, after arresting Mr Mallick, searched the property for a day.

According to sources, Mr Mallick was going to plead not guilty because it was a broker who had originally arranged all the paper work to obtain mortgage for Mr Mallick and for this, he was paid in the tune of about 6 thousand GBP. But the solicitor advised Mr Mallick that on prima facie the charges of mortgage fraud in a court before the jury could lead to wider exposure of the matters relating to the MQM where further witnesses could have been called to explain the property portfolios and the large cash balances. The prosecution paper clearly state that Mr Mallick is a central MQM leader and also son-in-law of Muhammad Anwar, one of the most senior MQM leaders and a key adviser to the party on international affairs.

The court papers say that Imbisat Mallick’s father-in-law is MQM’s senior leader and that he would be able to “purchase the house for cash if he was inclined to do so”.

The court papers show that the prosecution made a witness statement in support of an application for a restraint order under Section 41 Proceeds of Crime Act 2002. This application in the case of Mr Mallick means that his sentencing is linked with the wider money-laundering probe because no cash was found during raid on Mallick’s hosue.

The News is aware that Mr Mallick was advised by his solicitors that a trial could open a Pandora’s Box that could lead to several MQM figures also standing in the court for witness statements and other forms of questioning. The source confirmed that Mr Mallick pleaded guilty to avoid that situation and therefore, he has become the first martyr for the party in the multiple active probes.

As mentioned above, several leaders of the MQM are distancing themselves from Mr Mallick that his conviction is a personal matter, but his case is a test for the MQM and throws up a dilemma for the party as in whether the party acknowledges his huge sacrifice or tries to distance itself from one of their closest associates who now finds himself behind the bars for his very involvement in the party affairs.

The court papers show that Regina Vs Waya mortgage fraud precedent was used in the Isleworth Crown Court to sentence Mr Mallick but Mr Waya, in a similar mortgage fraud case, was sentenced to 80 hours of community service reflecting the judge’s view of the relatively low level for his culpability. The judge in the case of Mr Waya went on to say that “he was not guilty of a serious mortgage fraud, involving dishonest overvaluation of property. There was no loss to the mortgage lender.”

The papers seen by The News show that the case involving Mallick relates to a property in London’s Northwood area, which is subject to a mortgage in the sum of £399,734 and the approximate value of the property is £637,000.

The papers show that “the benefit will be the amount of equity in the property that can be attributed to the amount gained from the fraud.

The present value of the house is approximately £637,000 so the equity is around £127,000. The mortgage of £434,945 represents 85 percent of the purchase price. The benefit gained by the fraud is therefore 85 percent of £127,000 which is £107,950.”

MQM advocates dual nationals’ right to franchise

KARACHI: Muttahida Qaumi Movement (MQM) senior leader Farooq Sattar, while talking to Masood Raza on Geo programme ‘Aaj Kamran Khan Kay Sath’, on Friday said that there should be no discrimination between those Pakistanis who live in Pakistan and those who live overseas because they are equal under the Constitution.

He said that taking part in democratic and electoral activities is a fundamental right of every Pakistani. According to Article 17, it forms part of fundamental rights while Article 25 envisages equality of all the people.

Farooq Sattar said that we thought that this discrimination should be done away with. Overseas Pakistanis not only have vast experience but they play a vital role in times of crisis and natural calamities. They are, in a way, country’s ambassadors.

He said that remittances sent by overseas Pakistanis are the backbone of the country’s economy, and depriving them of their fundamental rights despite their contributions is highly unjust. That would be tantamount to calling their patriotism into question.

The MQM leader said that almost all the countries of the world allow their citizens to have dual nationalities whether it’s the USA, Britain, Italy, Holland, South Korea or Malaysia. If the law in these countries allows dual nationalities then they also have the right to contest elections. In fact, some countries have now gone to the extent wherein they not only allow dual nationality holder to contest elections in their country of origin but also have reserved seats in Parliament for such people. Italy, Holland and South Korea are the countries with reserved seats for dual nationality holders, he added.

He said that there is not a single country which, while allowing people to have dual nationality, restricts their contesting of elections. The bill that we have presented says that a person with dual nationality can contest elections. This is the spirit of Articles 17 and 25. There was a flaw in Article 63-1C which we have amended. The said Article had envisaged disqualification of a person upon their acquiring a dual nationality. Our bill opposes this treatment and it envisages that only when a person surrenders their Pakistani nationality do they become liable for disqualification but not the ones who retain their Pakistani citizenship while acquiring that of a foreign county.

While responding to a question about PPP-MQM talks, Farooq Sattar said that they are attempting to create an environment of confidence-building. Stability in Sindh means stability in Pakistan, and stability in Sindh comes from complete understanding between the rural and urban populations, which is the need of the hour. He said that confidence-building measures (CBMs) are important in order to highlight the problems faced by the urban population.

The MQM leader said that his party has been into CBMs in the wider interests of conciliation.

While commenting on the tweet of Bilawal Bhutto, Farooq Sattar said that Asif Zardari will take notice of it while asking himself the question whether Bilawal’s tweet helps the process of conciliation or whether it hurts it.

MQM keen on joining Sindh government: Bilawal

KARACHI: Pakistan Peoples Party (PPP) patron-in-chief, Bilawal Bhutto Zaradi in a message Twitter said the MQM was keen on joining the provincial government in Sindh.

Bilawal tweeted it would be impossible to work with the MQM if they did not retract their support for martial law and breaking Sindh.

On Wednesday, MQM leader Faisal Sabzwari said talks between his party and the PPP were holding discussions over joining the provincial government. Sabzwari added

A meeting was also held on Wednesday between Sindh Chief Minister Qaim Ali Shah, Former Interior Minister Rehman Malik and Governor Sindh Dr Ishratul Ebad wherein relations between the PPP and MQM were discussed.

MQM gets offer to join Sindh government

KARACHI: The Muttahida Qaumi Movement (MQM) confirmed on Wednesday that the party had received an offer to join the Sindh government, but said that it was holding deliberations within party ranks following the talks held in Karachi between former interior minister Rehman Malik, the Sindh governor and the chief minister.
This was disclosed to The News by MQM leader and member Coordination Committee Waseem Akhtar just after Rehman Malik held a meeting with Dr Ishratul Ebad Khan at the Governor House and later called on Sindh Chief Minister Syed Qaim Ali Shah.

Waseem said that the ruling Pakistan People’s Party (PPP) has offered the MQM to join the government, adding that the MQM has not demanded any portfolios as being reported in a section of the press.

He said that it was the second meeting in Karachi between Qaim Ali Shah, Rehman Malik and Dr Ishratul Ebad but added that the MQM Coordination Committee would take a final decision on whether to join the government or not.

Waseem was again asked to when the MQM would be joining the government, to which he said, “No decision has been taken as yet…Discussions are under way in this regard”.He mentioned that Governor Ebad had earlier met former president Asif Ali Zardari in Dubai to sort out various issues.

Waseem said that departments and ministries did not matter for the MQM.It may be noted here that Sindh Minister for Information Sharjeel Inam Memon had told a press conference at the Sindh Assembly that he would neither confirm nor contradict reports about the MQM joining the government.

He had further said that ministries or departments did not matter for the ruling party as the same could be changed at any time. However, Speaker Sindh Assembly had told The News that important departments could not be given to Muttahida.

It may be noted here that the MQM normally takes time to join the government as they say that they have had bitter experiences in the past and that they are accountable to their people and voters.Rehman Malik has been playing a vital role to bridge the gap between the PPP and the MQM.

Earlier, the ruling PPP and the opposition MQM remained engaged in negotiations to evolve a power-sharing formula and both sides were hopeful that the issues would be resolved amicably.

Sources said that both sides were busy settling the remaining issues and clearing the way for the MQM to join the Sindh government. However, independent sources claimed that the ruling party was trying to convince the MQM not to insist on the local government and excise portfolios, as the PPP had been holding both portfolios in the previous tenure and there were reservations in the party ranks on this demand.

The MQM spokesperson rejected the impression that the process of talks was affected due to the statements of some PPP leaders against the MQM and pointed out that the dialogue was still in process as per the advice of the top leadership of both parties. He pointed out that the party leaders were bound to follow the instructions of the party chief and avoid talking to the media as the high command of both parties agreed that no party leader would speak against each other in the media.

PPP leader Syed Khurshid Shah had recently raised objections against MQM chief Altaf Hussain for his statement regarding the role of the army, while Speaker Sindh Assembly Agha Siraj Durrani also criticised the MQM’s demand for the local government and excise portfolios.

However, the MQM spokesman said that the party leaders would not speak in the media against any PPP leader and hoped that the PPP would also follow the instruction of their party high command in this regard.

The Governor’s House issued a statement that during their meeting, Dr Ishrat-ul-Ebad, Qaim Ali Shah and Rehman Malik agreed that both the PPP and the MQM believed in political harmony and reconciliation. They also said the leaderships of the two parties were engaged in talks to become coalition partners.
