Non-bailable arrest warrants for Gilani, Fahim issued again

KARACHI: The Federal Anti-Corruption Court (FACC) on Monday issued non-bailable arrest warrants of five accused including former PM Yusuf Raza Gilani and former commerce minister Makhdomm Amin Fahim in seven cases concerning the Trade Development Authority of Pakistan (TDAP) scam.

The court headed by Muhammad Azeem has now issued non-bailable warrants of arrest in seven cases filed by FIA against Yusuf Raza Gilani, Amin Fahim and former secretary to the prime minister’s house, Zubair. In these cases, the FIA submitted seven charge sheets and showing the three accused as absconders.

Consequently, the court issued non-bailable warrants of arrest against the three accused involved in the TDAP scam. Earlier, on May 29 an anti corruption court had issued non-bailable arrest warrants against Gilani and Fahim.

In these cases, the two PPP leaders were accused of misappropriation of huge funds and the apex court of the country had also taken notice of alleged plundering of national exchequer under one pretext or the other by the accused.

A bench headed by the then Chief Justice Iftikhar Muhammad Chaudhry had heard the corruption cases relating to different departments and had directed the FIA to investigate, report and lodge cases.

The cases that were lodged after investigation were now being heard by the FACC that had earlier given Amin Fahim an exemption from appearance in the court and at times it had directed the defence counsel to ensure the appearance of his client at the next hearing.

In some of the cases, the trial court had declared to frame charges against the accused, but due to non-appearance of some of the accused, including Amin Fahim, it could not happen. The court now has issued non-bailable arrest warrants against the two accused along with other absconding accused.

The investigators have been made bound to ensure arrest of the accused and their production before the court on June 17 when the court would sit again to hear these seven cases. The FACC has ordered the Federal Investigation Agency (FIA) to produce all the accused before the court by June 17.

Earlier the FIA had declared Yusuf Raza Gilani and Makhdomm Amin Fahim as fugitives in cases linked to TDAP scam and the court ultimately had to pass the above orders as part of legal proceedings.

The FIA mentioned in its charge sheet that former TDAP chairman Tariq Iqbalpuri, former director general Javed Anwar, Abdul Karim Daud and former project manager Mirchumal Khatri had already been arrested and recorded their statement while Gilani and Amin Fahim’s names were included in the light of the statements recorded by the detained accused. In these cases the warrants against the two PPP leaders have been issued by two courts (in Karachi and in Islamabad). Seven other accused have also been declared as absconding and non-bailable warrants of arrest were issued against these accused as well. The court had previously issued notices (three times) to Yusuf Raza Gilani and Makhdoon Amin Fahim, directing them to appear before it.

Malala makes it again to Time’s 100

NEW YORK: Malala Yousafzai is among the world’s most influential people, according to a list published by the Time magazine on Saturday.

Malala, 16, is the only Pakistani on the list of people, who according to the magazine have inspired others around the world.

The list also includes a profile by another star, explaining why the person deserves a spot.

Former US Congresswoman Gabrielle Gifford who was shot in the head in Tuscon, Arizona, in 2011 paying tribute to Malala praises the Pakistani activist’s courage and resilience.

Gifford wrote for Time that she, like many people, draws inspiration and strength from Malala Yousafzai, who was also shot in the head by the Taliban in 2012.

“Malala is a testament that women everywhere will not be intimidated into silence.” “I have seen courage in many places, but Malala’s courage is uncommon,” Giffords wrote.

In July, Malala spoke at the UN and reminded viewers that everyone’s voice matters in the fight for education. “One child, one teacher, one pen and one book can change the world.”

The teen activist, who published her first book I Am Malala in October, was also nominated for the Nobel Peace Prize last year.

Giffiord wrote, “I have seen courage in many places in the thousands of our nation’s military members I have met and represented; in those who ran toward the gunfire in a Safeway parking lot on January 8, 2011; and in our leaders who take the tough votes because it’s the right thing to do, but Malala’s courage is uncommon.”

“In the face of oppression and bitter injustice, she demands education and opportunity. In the face of violence from the hands of cowards, she refuses to back down.”

Malala was also selected to write the profile of former US secretary of state Hillary Clinton, a potential presidential candidate in the next election, who also figures on the list of world’s most influential people, calling her “a symbol of strength for women across the world”.

The Pakistani activist wrote, “It was she (Clinton) who famously said, ‘Women’s rights are human rights’. She not only spoke those words, but also dedicated her life to empowering women around the world through politics and philanthropy. She has been a source of strength for many women, including myself, my family and those who stood by me after I was attacked.”

FBI revives claim that Russian authorities did not share information on Tamerlan Tsarnaev, the deceased Chechen-origin suspect

The U.S. and Russia continued to trade blame between their investigative agencies on the Boston Marathon bombing case, with the Federal Bureau of Investigation this week reviving a prior claim that Russian authorities did not share information with it on Tamerlan Tsarnaev, the deceased Chechen-origin suspect.
According to a report in the New York Times citing an Inspector General’s report, “The Russian government declined to provide the FBI with information about [Tamerlan] that would most likely have led to more extensive scrutiny of him at least two years before the attack.”
Quoting unnamed officials, the Times added that the Inspector General’s report found that “it was only after the bombing occurred last April that the Russians shared with the FBI the additional intelligence, including information from a telephone conversation the Russian authorities had intercepted between Mr. Tsarnaev and his mother in which they discussed Islamic jihad.”
However, not many media reports on this subject noted that the claims linked to the FBI were not new, fewer still the Boston bombing case was hobbled as much by blockages to information sharing domestically between U.S. investigative agencies such as the FBI and the Department of Homeland Security, as by limited information from Russia.
Lax cooperation

For example, last year The Hindu reported that even a decade after al-Qaeda’s devastating attack on the U.S. on September 11 2001, lax intelligence cooperation seems to dog law enforcement agencies, leading Senator Susan Collins, a top Republican on the Homeland Security Committee, to say what “is troubling to me [is] that this many years after the attacks on our country in 2001, that we still seem to have stovepipes that prevent information from being shared effectively not only among agencies but also within the same agency in one case.”
The FBI at the time had put out a statement that it received a Russian alert in 2011 that Tamerlan “was a follower of radical Islam and a strong believer, and that he had changed drastically since 2010 as he prepared to leave the U.S. for travel to the country’s region to join unspecified underground groups.” This statement was repeated in the Inspector General’s report, as quoted by the Times.
The FBI also said its subsequent interview with Tamerlan and a search for information did not yield evidence of terrorism activity. Since then the FBI also “requested but did not receive more specific or additional information,” from Russia, the agency added.
However, the fact that appeared to receive less public attention was that the Russian Federal Security Service (FSB) had “multiple” contacts with the FBI and at least one was after October 2011, according to reported remarks of Senator Richard Burr, a North Carolina Republican who is also on the Intelligence Committee. From the evidence available so far, it appears that information “was not shared with the original team who interviewed Tamerlan,” or with other DHS officials.
The allegations in the report criticising Russian intelligence services come on the back of deteriorating relations between Washington and Moscow, especially in the wake of Russia annexing Crimea from Ukraine, and, last year, granting temporary asylum to Edward Snowden, the whistleblower and former National Security Agency contractor who supplied media with confidential documents on the NSA’s surveillance activities.

Extrajudicial killings?: MQM walks out of the session, again

KARACHI:  During the session, MQM lawmakers staged a token walkout of the assembly proceedings against the arrest and ‘extrajudicial killings’ of their workers in Karachi.
Soon after reciting Fateha, the deputy parliamentary leader of the MQM, Khawaja Izharul Hassan, drew the speaker’s attention towards the death of their another activist, Mohammad Adil, whose was subjected to torture by the police and law-enforcement agencies after his arrest on February 8.  “As many as 10 workers of our party have fallen victim to extrajudicial killings and 45 activists are missing,” he said, adding that they have approached the police and law-enforcement agencies, but no one was willing to disclose their whereabouts.
“Our party activists are being victimised in the name of ongoing operation. This kind of operation has deepened the sense of deprivation. It seems that the Sindh government has given a free hand to law enforcers to kill our people,” he said.
The MQM leader said that they would not tolerate and resist the state operation against their people. “We are now staging a walkout and this protest will continue until the government stops victimising us,” he added.  After a few minutes walkout, they returned to the session and took part in the proceedings.
